DENZ Concrete & Property Services
These Terms and Conditions apply to services supplied by [insert registered business name], trading as DENZ Concrete & Property Services, ABN [insert ABN] (“DENZ”, “we”, “us” or “our”).
“Customer”, “you” and “your” mean the person or organisation requesting or purchasing our services.
1. OUR SERVICES
DENZ provides residential concrete and property services across Melbourne, which may include:
* Concrete driveways, pathways and slabs
* Plain, coloured and exposed aggregate concrete
* Concrete repairs
* Landscaping and garden improvements
* Interior and exterior painting
* Property repairs and maintenance
* Deck sanding and staining
* Plastering, sanding, caulking and regrouting
* Weatherboard repairs
* Deep cleaning and detailed cleaning
* Other services described in an accepted quote
The exact work included will be listed in your written quote or service agreement.
2. QUOTES
Quotes are prepared using the information available at the time, including measurements, photographs, site observations and details provided by the customer.
Unless stated otherwise:
* Quotes remain valid for 30 days.
* Only work specifically listed in the quote is included.
* Additional work, materials or services will be treated as a variation.
* Approximate measurements or quantities may be adjusted following an on-site inspection.
* A quote may be withdrawn before acceptance if an error, omission or unexpected issue is identified.
A request for a quote does not oblige either party to proceed.
3. ACCEPTING A QUOTE
A quote is accepted when you:
* Approve it in writing
* Sign the quote or service agreement
* Pay the requested deposit
* Instruct us to begin the work
By accepting a quote, you confirm that you have reviewed the scope, price, exclusions, finishes and payment terms.
Where Victorian law requires a separate domestic-building contract, work will not proceed until the required contract and documentation have been completed.
4. DEPOSITS AND PROGRESS PAYMENTS
Any deposit or progress-payment schedule will be shown in your quote or contract and will comply with applicable Victorian law.
The deposit secures scheduling and may be used towards materials, equipment bookings and other authorised preparation costs.
Progress payments may apply to larger jobs. Unless otherwise agreed in writing, the final balance is payable when the quoted work is completed.
We will not request advance payments that are prohibited by law.
5. PAYMENT
Invoices must be paid by the due date shown on the invoice.
If an invoice remains unpaid, we may pause further work after giving reasonable notice. The customer may also be responsible for reasonable costs incurred in recovering an overdue payment, where permitted by law.
Payment must not be withheld for unrelated work or minor items that do not prevent the quoted stage or service from being completed. Any concern should be raised with us promptly so it can be inspected and addressed.
6. SCHEDULING
Proposed start and completion dates are estimates unless expressly guaranteed in writing.
Timing may change because of:
* Rain, heat, wind or unsuitable weather
* Supplier or concrete-plant delays
* Material availability
* Equipment breakdown
* Site-access restrictions
* Permit or inspection delays
* Unsafe site conditions
* Illness or circumstances outside our reasonable control
* Additional work requested by the customer
We will communicate material scheduling changes as soon as reasonably possible.
7. SITE ACCESS AND CUSTOMER RESPONSIBILITIES
The customer must provide safe and reasonable access to the work area at the agreed times.
Before work begins, the customer must:
* Remove vehicles, furniture, personal belongings and fragile items unless otherwise agreed.
* Keep children and pets away from the work area.
* Advise us of concealed pipes, cables, irrigation, drainage, septic systems or other underground services.
* Tell us about known asbestos, hazardous materials, structural concerns, leaks, mould or unsafe conditions.
* Arrange access to water and electricity where reasonably required.
* Obtain any approval required from an owner, body corporate, landlord or neighbouring property owner.
* Ensure we can lawfully access shared driveways, adjoining land or restricted areas where needed.
We are not responsible for delay or additional cost caused by undisclosed conditions or unavailable access.
8. UNDERGROUND AND CONCEALED CONDITIONS
Unless included in the quote, our pricing does not allow for concealed or unexpected conditions such as:
* Unstable, contaminated or unsuitable soil
* Buried concrete, rock, rubble or construction waste
* Unmarked pipes, cables or drainage
* Tree roots
* Asbestos or hazardous material
* Hidden water damage, rot or structural defects
* Previous work that does not comply with relevant requirements
If an unexpected condition is discovered, we may pause the affected work, explain the issue and provide a variation before proceeding.
9. PERMITS, APPROVALS AND SPECIALIST WORK
The quote will state whether DENZ or the customer is responsible for permits, engineering, council approvals, asset-protection permits, inspections or other authorisations.
Unless expressly included, these items are the customer’s responsibility.
Electrical, plumbing, structural or other regulated work will only be performed by appropriately qualified or licensed tradespeople where required by law.
10. VARIATIONS
A variation is any change to the agreed scope, materials, dimensions, quantities, finish, access requirements or method of work.
Variations may arise because of:
* A customer request
* An unexpected site condition
* Incorrect or incomplete information
* A required safety or compliance measure
* Changes requested by an authority, engineer or inspector
* Additional deterioration discovered after work begins
Where reasonably practical, variations will be described and priced for approval before the additional work proceeds.
Urgent work required to make the site safe may be undertaken where it is reasonable to do so, with the customer informed as soon as possible.
11. MATERIALS AND PRODUCT AVAILABILITY
Materials, colours, finishes and products are subject to supplier availability.
If a specified item becomes unavailable, we will discuss a reasonably comparable alternative before substitution.
Samples, photographs and screens provide an indication only. Actual colour, texture and appearance may vary because of raw materials, manufacturing batches, lighting, weather and surrounding surfaces.
12. CONCRETE WORK
Concrete is a natural, site-installed material. Variations in colour, texture, aggregate exposure and finish are normal and do not necessarily indicate defective work.
The customer acknowledges that:
* Minor surface variations may occur.
* Concrete colour can change while curing.
* Existing and new concrete may not match exactly.
* Repairs and patches may remain visible.
* Exposed aggregate varies naturally in stone placement and exposure.
* Coloured concrete may vary between batches and surrounding areas.
* Concrete can develop minor cracking because of shrinkage, temperature changes, soil movement, tree roots, loading or other site conditions.
We use appropriate preparation, reinforcement and control-joint practices for the agreed work, but no concrete contractor can honestly guarantee that concrete will remain completely crack-free.
Unless included in the quote, additional drainage, engineering, excavation, soil treatment and rectification of unrelated ground movement are excluded.
13. CONCRETE CURING AND USE
Customers must follow the curing and access instructions we provide.
Heavy foot traffic, vehicles, furniture, chemicals, pressure washing or other loads must not be placed on new or repaired concrete until the advised waiting period has passed.
DENZ is not responsible for damage caused by early use, customer interference, third parties, pets, vehicles, weather events or failure to follow curing instructions.
14. CONCRETE REPAIRS
Concrete repairs are intended to improve the safety, function or appearance of the affected area. A repaired section may remain visible and may not perfectly match the colour, texture or aggregate of the surrounding concrete.
Repairing the surface may not permanently resolve damage caused by continuing soil movement, drainage problems, tree roots, structural movement or excessive loads.
We will advise when replacement appears more practical than repair, but the final decision remains with the customer unless safety or compliance prevents us from completing the requested repair.
15. LANDSCAPING
Plants, turf and natural materials may vary in colour, size and appearance.
Unless ongoing maintenance is included, the customer is responsible for watering, mowing, feeding, pruning and caring for plants and turf after handover.
Plant survival can be affected by heat, frost, pests, disease, pets, watering, soil conditions and maintenance. A plant-replacement guarantee applies only when expressly stated in writing.
Natural settling of soil and mulch may occur after installation.
16. PAINTING AND SURFACE FINISHES
Painting results depend on the condition of the existing surface.
Unless specifically included, quotes may exclude:
* Major plaster repairs
* Structural cracking
* Hidden water damage
* Mould remediation
* Lead-paint or asbestos treatment
* Removal of failed coatings
* Repairs revealed after preparation begins
Existing colours, stains, repairs and surface texture can affect the finished appearance. Additional preparation or coats may require a variation if the underlying condition could not reasonably have been identified beforehand.
Paint colours should be approved by the customer before application. DENZ is not responsible for a change of preference after an approved colour has been applied.
17. PROPERTY REPAIRS AND MAINTENANCE
Maintenance and repair services address the specific items identified in the quote.
We do not guarantee that a localised repair will correct a separate structural, moisture, plumbing, electrical or building defect.
If a larger issue becomes apparent, we may recommend further investigation by an appropriately qualified professional.
18. DEEP CLEANING
Deep cleaning improves the cleanliness and presentation of accessible surfaces but does not guarantee the removal of every stain, mark, odour, discolouration or permanent defect.
Results may be limited by:
* Age or condition of the surface
* Permanent staining
* Worn coatings or finishes
* Porous materials
* Existing damage
* Mineral deposits
* Mould beneath or within materials
* Areas that cannot be accessed safely
Mould cleaning relates to visible surface cleaning unless professional mould assessment or remediation is expressly included. Underlying leaks, ventilation problems and moisture sources remain the customer’s responsibility.
We may decline to clean an item if doing so could reasonably cause damage.
19. CUSTOMER-SUPPLIED MATERIALS
Where a customer supplies materials, fixtures, paint or products, the customer is responsible for confirming that they are suitable, complete and available when required.
DENZ is not responsible for defects, delays, incompatibility, insufficient quantities or manufacturer issues relating to customer-supplied products.
Additional time caused by unsuitable or missing materials may be charged as a variation.
20. COMPLETION AND INSPECTION
The customer should inspect the work when notified that it is complete and raise any concern within a reasonable time.
We must be given a reasonable opportunity to inspect and, where appropriate, correct work before another contractor alters or repairs it.
Minor incomplete items that do not prevent normal use may be recorded and completed within an agreed reasonable period.
21. CANCELLATIONS AND POSTPONEMENTS
Cancellation or postponement requests must be provided as soon as possible.
Where permitted by law, the customer may be responsible for reasonable costs already incurred, including:
* Specially ordered or non-returnable materials
* Supplier cancellation charges
* Equipment or concrete bookings
* Permits and administration already completed
* Work already performed
We will not charge a cancellation amount that is disproportionate to our reasonable loss.
If DENZ cancels work without a lawful reason, any payment for services not supplied will be refunded, less any amount properly payable for completed or authorised work.
22. WEATHER AND SAFETY
DENZ may pause, reschedule or alter the work method when weather or site conditions could affect safety or quality.
We may stop work if the site becomes unsafe, abusive behaviour occurs, hazardous material is discovered or the customer prevents the work from being completed safely.
Any resulting delay or reasonable additional cost will be discussed with the customer.
23. DAMAGE AND EXISTING CONDITIONS
We will take reasonable precautions while working at your property.
DENZ is not responsible for:
* Pre-existing damage or deterioration
* Defects concealed before work began
* Items left within the work area
* Damage caused by inaccurate customer instructions
* Undisclosed underground services
* Normal vibration associated with authorised work
* Damage caused by third parties after completion
* Events outside our reasonable control
Nothing in these terms excludes liability that cannot lawfully be excluded.
24. PHOTOGRAPHS
We may photograph the work area for quoting, job records, progress reporting and quality control.
Photographs that identify the customer, house number, vehicle registration or other personal information will not be used for marketing without permission.
Before-and-after photographs may only be published with the customer’s consent or after identifying information has been removed.
25. CONSUMER GUARANTEES
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that services will be provided with due care and skill, be reasonably fit for an agreed purpose and be supplied within a reasonable time where no timeframe has been agreed.
Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
26. WARRANTIES
Any additional workmanship warranty will be described in the applicable quote, invoice or written warranty.
A warranty may not cover damage caused by:
* Ground, soil or structural movement
* Drainage problems or water ingress
* Tree roots
* Overloading or misuse
* Accidental or third-party damage
* Failure to follow maintenance or curing instructions
* Unauthorised alterations or repairs
* Normal wear and weathering
* Defective customer-supplied materials
* Conditions outside the quoted work
These exclusions do not limit rights available under the Australian Consumer Law.
27. COMPLAINTS AND DISPUTE RESOLUTION

We will review the concern, arrange an inspection where appropriate and attempt to resolve the matter fairly.
If a resolution cannot be reached, either party may use an appropriate Victorian dispute-resolution service or exercise any legal rights available to them.
28. PRIVACY
Personal information is collected and used to:
* Respond to enquiries
* Prepare quotes
* Schedule and perform services
* Process payments
* Maintain business records
* Meet legal and insurance obligations
* Communicate about the requested work
We will not sell personal information. Information may be shared with suppliers, subcontractors, payment providers, insurers or authorities where reasonably required to provide the service or comply with the law.
29. WEBSITE INFORMATION
Website content, calculators, photo-analysis tools, guides and estimated quantities are provided as general information only.
Online calculations and photo-based assessments are preliminary and do not replace an on-site inspection, engineering advice, professional diagnosis or a written quote.
Website photographs are illustrative and do not guarantee an identical result at another property.
30. CHANGES TO THESE TERMS
We may update these Terms and Conditions when our services or legal obligations change.
The terms applying to an accepted job will be those supplied or available when the quote is accepted, unless both parties agree otherwise in writing.
31. GOVERNING LAW
These Terms and Conditions are governed by the laws of Victoria, Australia.
The parties submit to the courts and tribunals with jurisdiction in Victoria.
